Kentucky Compliance Expert Pushes for Reform After Setbacks in Drug‑Testing Industry and FMCSA Clearinghouse Failures


Bush, KY — April 20, 2026  

Brandi Daniels, a Kentucky‑based compliance specialist and owner of RTDPro and PRO COMPLIANCE ADVISOR, is speaking out about the growing challenges facing drug‑testing providers and CDL drivers navigating the Federal Motor Carrier Safety Administration (FMCSA) Clearinghouse. After years of helping drivers, employers, and owner‑operators work through violations, petitions, and return‑to‑duty requirements, Daniels says the system is “breaking the very people it was designed to protect.”


Daniels, who operates within a two‑hour mobile testing radius and provides SAP coordination, follow‑up plan management, and Clearinghouse petition assistance, has faced her own setbacks in the industry — from inconsistent reporting by employers to drivers being trapped in prohibited status due to administrative errors.


“These aren’t small mistakes,” Daniels said. “A single incorrect entry can cost a driver their livelihood for months. And when the Clearinghouse won’t correct it quickly, the driver pays the price, not the system that failed them.”

Growing Problems Inside the Clearinghouse


According to Daniels, the most common issues she sees include:


- Employers failing to update Return‑to‑Duty results, leaving drivers stuck in prohibited status even after completing all requirements.  

- SAP reports uploaded incorrectly or not at all, causing delays that can stretch into weeks.  

- Drivers with no employer left without guidance, despite FMCSA rules requiring them to complete Subpart O steps.  

- Petitions taking too long, even when documentation clearly proves an error.  

- Confusion about who is responsible for each step, especially for owner‑operators.


“These delays don’t just hurt drivers,” Daniels explained. “They hurt families, companies, and the entire supply chain. A driver who should be back on the road in 10 days is sometimes sidelined for 10 weeks.”

Setbacks in the Drug‑Testing Business


Daniels has also faced challenges on the business side:


- Increased administrative burden due to Clearinghouse inconsistencies.  

- Drivers arriving with misinformation, often from untrained third parties.  

- Testing delays caused by employer miscommunication, which then reflect poorly on service providers.  

- A surge in drivers needing petition assistance, overwhelming small compliance businesses.


“People assume the drug‑testing business is simple,” Daniels said. “But when the federal database is inconsistent, every mistake becomes my problem to fix — and the driver’s problem to live with.”

What Needs to Change


Daniels is calling for several reforms she believes would dramatically improve fairness, accuracy, and efficiency:


1. Mandatory Employer Accountability

Employers who fail to update records should face penalties, especially when delays harm a driver’s ability to work.


2. Faster Petition Review Times

Petitions involving clear administrative errors should be resolved within 72 hours, not weeks.


3. A Dedicated Clearinghouse Support Line for Drivers

Currently, drivers have no direct human support. Daniels argues that a staffed hotline is essential.


4. Standardized SAP Reporting Requirements

SAPs should be required to upload reports in a uniform format to reduce errors and inconsistencies.


5. A “Driver Advocate” Role Within FMCSA

Daniels proposes a new position dedicated to helping drivers without employers navigate Subpart O requirements.


6. Automatic Alerts for Missing or Incorrect Data

The Clearinghouse should notify drivers immediately when an employer or SAP fails to upload required documentation.

A Voice for Drivers


Despite the setbacks, Daniels continues to advocate for drivers who feel lost in the system.


“Drivers deserve accuracy, transparency, and a fair chance to return to work,” she said. “The Clearinghouse is supposed to protect the public, not punish people for clerical errors.”


As the trucking industry faces ongoing driver shortages and increasing regulatory complexity, Daniels believes reform is not optional — it’s urgent.


“Fixing the Clearinghouse isn’t just about compliance,” she added. “It’s about restoring trust in a system that millions of drivers depend on.”
